We are Quality Tools Limited a company registered at 54 Beech Avenue, New Basford, Nottingham, NG7 7LQ (No 5976830). When you (the person named on the order) place an order with us we do business together under the following terms: DEFINITIONS In these conditions:-
1. Prices We offer goods for sale through our telephone ordering service, our website www.qualitytoolsltd.co.uk, advertisement leaflets and promotional material. Prices shown will always include VAT and Delivery. The price payable for the goods you order is as set out on our web site at the time you place your order. 2. VAT The prices we quote include VAT at the applicable rate. 3. Payment All of our goods are offered to you on a payment with order basis. Your payment is due to us when we dispatch your goods and is accepted by most credit cards and debit cards. We will only accept your order if it is accompanied by payment in full. We do not provide credit accounts. All goods, delivered or not, remain our property until payment is received in full. Until such time as payment in full is made you shall retain such goods separately from other goods and clearly mark them in such a way that they can be readily identified as being our property and any payment received by you for any sale of such goods must be held in a separate account in trust for us. In the event of non-payment by you for goods we will, without loss of any rights or remedy, remove from your possession those goods belonging to us in accordance with these conditions and we shall be entitled to enter upon the property where the goods are stored and repossess and remove the same. You hereby grant us irrevocable license to enter your premises for the said purposes. 4. Dispatch We will normally dispatch your goods on the same working day, provided that your order is received by us before 4pm. The goods become your property as soon as they are dispatched to you. 5. Delivery Our standard delivery service is a next day delivery using a national carrier, therefore you will usually receive your goods the next working day. We endevour to deliver your order to you as quickly as possible and it is our policy to have as many of our products as possible available for Next Day Delivery. Products that take longer to deliver are clearly stated on the products webpage. All delivery times refer to normal business days (Monday to Friday). Orders received after 1.45pm will be treated as if they had been received on the NEXT working day. For remote areas such as the Highlands of Scotland and Offshore delivery can take several days. Offshore deliveries may incur an additional charge. Delivery to Northern Ireland is unavailable. 6. Receiving Orders Unless we have your written authorisation, we will always require an authorised signature when delivering goods to you. 7. Availability We aim to keep sufficient stock, either in our warehouse or in our suppliers warehouse so that we never run out, we also have a stock control system so you should never be able to place an order if we have already sold out. However, if this does happen we will contact you immediately to inform you and discuss further options, such as a full refund or free delivery when we have restocked the item to make up for our mistake. 8. Cancellation If you wish to cancel your order you may do so at any time until we dispatch it. Your order will be packed and dispatched in a very short period. If you wish to cancel the order you should do so by telephoning 0800 6344368 and we will confirm that it has been possible. 9. 7 Day Cancellation Under the Consumer Protection (Distance Selling) Regulations 2000 non-business purchasers are entitled to a 7 working day cancellation period. Should you wish to cancel your order please inform us in writing within 7 working days of the date of delivery. You will be responsible for the cost of returning the goods to us. This cancellation period does not constitute a “free trial period” and you will be responsible for returning the goods in the original packaging and condition. The refund for the goods will be actioned within 30 days of the return of the goods. 10. Statutory Rights If any of the goods we supply fails to perform satisfactorily due to faulty materials or workmanship you may return them to us for repair or replacement, partial or full refund depending on the nature of the fault and the length of time since purchase. All we ask is that you contact us first on 0800 6344368 or orders@qualitytoolsltd.co.uk providing an explanation of the problem and details of the purchase. Most of our goods come with a manufacturers warranty and we may be able to offer faster assistance by directing you to your nearest authorized repair agent for repair under warranty. 11. Our Mistakes We are constantly updating our products range and prices. We feel assured that our staff and systems are competent and reliable, but we also acknowledge that mistakes may happen. If mistakes are made we will try our hardest to put them right. If goods are offered for sale incorrectly we will always try to honour our offer. There may be rare circumstances where it is not possible for us to do so. In such cases we will contact you and explain the situation, if we are unable to resolve the matter fairly with you we reserve the right to refuse your order and refund any payment you may have made. 12. Unforeseen Circumstances Where things like strikes, wars, acts of terrorism or even small things like power cuts interfere in our business with you, we will do our best to keep things going. We shall have no liability to you for any failure which is due to such unforeseen circumstances or any other situation outside our control. 13. Time Limits Any time or date quoted by the Company for delivery or collection of all or any of the Goods or performance of any Services is an estimate only, and the Company shall not be liable for any failure to meet any estimate nor for any loss, whether financial or otherwise resulting directly or indirectly therefrom. Time is not and shall not be the essence in relation to this condition or the performance by the Company of its obligations under the Contract. 14. Age Restrictions Age restrictions apply to the supply of some goods. By ordering these goods you confirm that you are over 18 and that the person receiving the delivery is also over 18. 15. Liability Nothing in these Terms of Business is intended to affect your statutory rights or to limit our liability for death, personal injury or fraudulent misrepresentation resulting from our negligence. If there is a problem with goods you receive please refer to Clause 10. We will not compensate for delivery delays or failures as this area is contracted out to a national carrier. In these circumstances our liability to you will be limited to a refund of the delivery charges you have paid. Our liability to you specifically excludes compensation for indirect or consequential loss or damage however it arises and except as described above will always be limited to a refund of your payment. 16. Law These terms of business will be interpreted and adjudicated under English law. |
